Abstract

The characterization of noise pollution constitutes a challenge because it is a type of event that leaves traces that are difficult to quantify and analyze, ceasing as soon as the activity of the emitting source is interrupted. Although there are regulations addressing this issue within the Brazilian legal framework, the measures adopted by public authorities to characterize this type of pollution may not be carried out effectively, mainly due to the specificity of the current technical standard and the difficulties in its interpretation by Criminal Experts. In order to contribute to a greater facilitation in this regard, the present work consists of an experience report concerning the measurement of sound pressure levels from a polluting source in a snack bar, aiming to provide the requesting authority with elements that would enable the classification of the applicable offenses. Thus, it was possible to establish the sound pressure levels, as required by the ABNT NBR 10151:2019 standard, based on the technical procedures necessary to characterize a siren as a tonal noise-emitting source. This report discusses the aspects and difficulties involved in applying the aforementioned technical standard, as well as the possible criminal implications.
